EU Design Reform
European Regulation No. 2822/2024 and Directive 2823/2024 on the protection of designs have been published in the Official Journal and will enter into force on 8 December 2024.
The provisions of the Regulation will be applied from 1 May 2025 while, as far as the Directive is concerned, the EU member states will have to transpose the provisions into the corresponding national laws by 9 December 2027.
The provisions of the Regulation include a broadening of the definition of products and designs, which will also include intangible products, 3D prints and animations, the introduction of a clause that excludes the protection of designs and models of spare parts of complex products, a centralized procedure before the EUIPO for the registration of new designs and models.
